A man has narrowly avoided prison after pleading guilty to stealing and providing a false name to police in separate incidents.
Police Prosecutor Sergeant Karl Rep told court Brandon Kane Councillor sprayed cologne on himself before placing the bottle into his right hand pocket and left Dalyellup Red Dot at 11.45am on June 10, 2017.
Councillor was later located by police at a residence in Wilkerson Way, Withers.
He then provided a name which police later found to be false. Councillor provided no reason as to why he gave a false name.
Councillor’s Lawyer Paul Chapman told Magistrate Mark Millington that Councillor was on a single parent pension but was able to pay fines.
He revealed Councillor had accepted the charges and was the only one that could look after the kids as his partner was in custody.
The court was told Councillor had received a 12 month suspended term of imprisonment on June 23, 2017.
Sgt. Rep said Councillor’s decision to provide false details breached the terms of the suspended sentence.
Magistrate Mark Millington acknowledged Councillor’s early guilty pleas but warned breaching a suspended sentence typically led to jail.
“You need to make sure you’re doing the right thing,” he told Councillor.
Councillor was fined $300, given court costs of $185 and had to pay $10 in compensation for the cologne.
His suspended sentence will continue until June 23, 2018.
