Sean Christopher Munns, 26, faced Bunbury Magistrates Court on Thursday, February 15 and pled guilty to charges of criminal damage or destruction of property, disorderly behaviour in public, threatening to endanger, injure or harm and trespassing without lawful excuse.
Police prosecutor Sergeant Greg Ward told the court Munns was at the residence of his mother and stepfather at around 3.45pm on Thursday, January 18.
He had become verbally aggressive towards his stepfather, before being asked to leave the premises.
The accused’s behaviour escalated, and was physically restrained by the stepfather before police arrived.
Munns had broken the lock and door to his sister’s bedroom while in the premises.
Munns was then taken to Bunbury Regional Hospital for treatment.
On Friday, January 19, police attempted to interview Munns at the hospital.
Munns then became abusive and refused to cooperate with officers.
While being arrested and placed in the police vehicle, Munns said “I should spit on you” to police.
Sgt. Ward showed Magistrate Belinda Coleman some of the abusive language used by Munns when he continued in the lock-up.
Lawyer Viv Blurton said Munns had been in an intoxicated state during the first incident. He said Munns had displayed a willingness to change and was due to start his new job last week.
Ms Coleman noted Munns had a “significant history for a young man” and reminded him the police had a hard enough time without him making matters worse.
Munns was given a concurrent term of six months and one day, suspended for 12 months.
He was given a global fine of $1000, and is required to undergo assessments for alcohol abuse and personal development courses.
Ms Coleman warned Munns that any breaches would most likely lead to jail.
